Terms & Conditions

Please note - these Terms & Conditions do not supersede your statutory rights under the Sale of Goods acts: they are merely designed to clarify the principles and procedures by which we operate. In any event, we aim to serve our customers fairly and squarely and - should a dispute arise - we will always seek to find a speedy and amicable solution to the problem.

Currency: All transactions are conducted in Pounds Sterling. If in doubt about the conversion rate to currencies other than Sterling, or those featured on the website, please e-mail us with the details of your order and we will calculate the accurate price in your own currency before accepting the order. Payments via this website will be processed in pounds sterling (credit cards sales will be charged in your local billing currency by your credit card provider). If you send a cheque or money order, it must be in £ Sterling.

Tariffs, Taxes & VAT

All £ Sterling prices on the Sport Spex website are quoted inclusive of local taxes (including VAT) where applicable.

For countries inside the EC, prices are quoted inclusive of taxes (including VAT) and tariffs. If a valid EU VAT Registration number is provided at the time of ordering, goods will be shipped to non-UK residents of the EU net of VAT.

For the USA , prices are quoted inclusive of all taxes and duty.

For all other countries, purchasers are responsible for duties and/or taxes levied at the point of entry into the destination country. 

Shipping Methods

Orders are sent to you via First Class Royal Mail or Airmail. We will always try to dispatch your goods within 48 hours of receipt of order, assuming we have the item/s in stock. Delivery to UK addresses is usually the next day after dispatch and overseas addresses between 2 to 5 days later. Please allow more time for delivery at busy periods like Christmas.

Payments

Security and protection is our priority.  Our preferred way of taking payment is Credit or Debit Card Transaction via or payment solution provider (PSP). Your payment will therefore be processed by Protx who perform industry-standard Address Verification System (AVS) and Card Verification Value (CVV) checks to prevent credit card fraud.  More information on Protx can be found at http://www.protx.com/.  Any payment details processed by Protx will not be seen by us or stored on our server.  In accordance with the UK Data Protection ACT your details will not be disclosed in any way to a third party, all details will remain strictly private.

You can also send a Cheque, Postal Order or Money Order separately to us. Please note that Card transactions are processed when goods are dispatched, Cheque and Money Order will be cleared before goods are dispatched. All Cheques or Money Orders must be drawn in £ Sterling.

Invoices & Receipts

We send a receipt for all orders which you will receive with the goods. This will show the amount paid for the item together with the amount of VAT paid.

Returns policy

At Sport Spex we recognize that it is important that your sports eyewear both looks good and feels good. If, when your chosen product arrives, you decide that it is not right for you Sport Spex operates a full, no-quibble Returns Policy.

In compliance with the EU Distance Selling Directive retail customers (excludes wholesale) may cancel or exchange their order contract by returning the order to Sport Spex within 7 days from the receipt of goods, in their original condition and fit for re-sale.  We will then refund the full value of the goods less the original delivery charges, as soon as possible and no longer than 30 days from the date of purchase. Please note the cost of the shipping cannot be refunded but in the event of the goods being faulty or a damage claim is supported, we will also refund monies to cover return shipping costs. Refunds will normally be made using the same method as the original payment.  (i.e. a credit card purchase will be refunded through your credit card account).

All return postage is the responsibility of the purchaser and Sport Spex Ltd do not accept responsibility for items lost or damaged in transit to us. 

For exchanges: Simply return your purchases to Sport Spex Ltd within 7 days of receipt, and we will despatch replacement goods. A re-delivery charge (at our standard rates) will apply.

Sport Spex Ltd reserve the right to refuse a refund or exchange if the goods are believed to have been damaged, or are not in their original condition. These Terms and Conditions do not affect your Statutory Rights.

Prescription Eyewear Terms and Conditions

In order to properly fit prescription lenses, we need the prescription as actually written by your Optometrist and which must be within the last 2 years. We prefer to see a copy of your prescription which you can fax to us on 01604 810363 or email to technicalhelp@sport-spex.com. If this is not possible we will take verbal or email details of your prescription which we will confirm back to you in writing but Sport Spex Ltd will not be held responsible if these details are supplied incorrectly in the first instance. We also need your PD (pupillary distance) measurements to ensure prescription is made accurately. You may be able to obtain your pupillary distance from whoever fit your last pair of glasses although they are not obliged to supply it. If you are having difficulty obtaining your PD please contact us for advice.

Prescription lenses are custom made products non-refundable (no exceptions).  If the prescription lenses are not made properly Sport Spex Ltd will re-make them until correct.  However, if you don't like the style or have distortion problems associated with highly wrapped styles, Sport Spex Ltd is not responsible for the lens cost.  The frame only may be returned for credit. The lenses will not be credited.  If concerned, order frame first to try, then send it back for a prescription lens. If your prescription is such that it is likely that you will experience some distortion we will advise you of this and you can then decide whether to proceed with your order at your own risk. Most people are able to accommodate to the distortion caused by wrapped lenses but this is not guaranteed.

Damaged Goods

Unfortunately, we are not responsible for damage which occurs after the goods have been handed to the postal service.  However, should you be unfortunate enough to receive damaged goods, let us know immediately. Please retain all relevant documentation so that we can make an insurance claim against the carrier's insurers. If the parcel you receive is battered, please note the fact when you sign for it, even before you open the package to examine the contents.  If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as ``Damaged package; goods not yet inspected" to warn the carrier that a claim may follow.

Title to the Goods

Title for goods belongs to Sport Spex until your full payment is cleared, at which point it transfers to you in its entirety.

Unavailable Goods

In the unlikely event that we are unable to supply your choice of goods for some while, or at all, we will contact you for instructions. Providing a telephone number or e-mail address with your order makes it easier for us to contact you in this event.

Please note that Card transactions are only processed when goods are dispatched, Cheque and Money Order will be cleared before goods are dispatched.

Applicable Law and Courts of Jurisdiction

All transactions undertaken through this website are governed by English Law and any legal actions arising out of such transactions shall be subject to the English legal processes and under the jurisdiction of English Courts. In the event of disagreement between Sport Spex and its clients, which cannot be mutually resolved in a reasonable time period, customers are invited to participate in a mediation process to settle the dispute. However, this is not compulsory and does not affect the consumer's rights to bring legal proceedings against Sport Spex If the mediation process is agreed, then either party may ask the Institute of Directors (UK) to appoint a mediator to settle any dispute before bringing the matter into the legal process. In this event, both parties agree to be bound by the decisions of such mediator and mediation process.
